Introduction

Anytime government regulates private property for the purpose of protecting groundwater resources or any land use activity, specific rules and procedures must be set for developers and residents. In some cases, failure to follow these rules and procedures will mean the failure of the regulatory program. Where regulations have been adopted to protect public health, avoidable failures, can be extremely costly. For example, a community that adopts a groundwater or drinking water protection regulation but fails to follow established rules for public hearings relating to the regulation adoption will lose the regulation if challenged in court. Voiding the regulation could have drastic consequences, both in terms of water quality and fines.

The importance of adopting and using regulatory tools according to specific and clearly defined rules cannot be overstated. To that end, the following materials are provided as guidance for the adoption, implementation and revisions to regulatory management techniques.
